The Second Amendment Explained: 2nd Amendment Facts Gun Nuts Overlook.

This post is for every clear thinking, logical, common sense American citizen who comprehends the pickle we Americans find ourselves in today.

 

Those of you who are NRA supporting gun nuts, and Westboro Baptist “church” idiots, please ignore this article. Go polish your gun barrel or clean an AK, while I talk to reasonable human beings.

 

You who stumbled into that latter category, why on earth are you reading anything on this blog anyway?

 

The Second Amendment

 

The Second Amendment (Amendment II) to the United States Constitution is the part of the United States Bill of Rights that protects the right of the people to keep and bear arms. It was adopted on December 15, 1791, along with the rest of the Bill of Rights.

 

In 2008 and 2010, the Supreme Court issued two landmark decisions concerning the Second Amendment. In District of Columbia v. Heller, 554 U.S. 570 (2008), the Court ruled that the Second Amendment protects an individual’s right to possess a firearm, unconnected to service in a militia and to use that arm for traditionally lawful purposes, such as self-defense within the home.

 

In dicta, the Court listed many longstanding prohibitions and restrictions on firearms possession as being consistent with the Second Amendment. In McDonald v. Chicago, 561 U.S. 3025 (2010), the Court ruled that the Second Amendment limits state and local governments to the same extent that it limits the federal government.

 

There are several versions of the text of the Second Amendment, each with slight capitalization and punctuation differences, found in the official documents surrounding the adoption of the Bill of Rights. One version was passed by the Congress, while another is found in the copies distributed to the States and then ratified by them.

 

 

As passed by the Congress:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
 
 

As ratified by the States and authenticated by Thomas Jefferson, Secretary of State:

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

 

The original hand-written copy of the Bill of Rights, approved by the House and Senate, was prepared by scribe William Lambert and resides in the National Archives.

 

 

December 15, 1791

This is the date the 2nd amendment was drafted and signed by our none too bright forefathers. See, they were none too bright because they neglected to include a clause against mentally ill, gun crazed, macho testosterone driven (both male & female) Americans with no regard for human life,….owning assault weapons and automatic handguns.

 

On December 15, 1791, there were flintlock pistols and black powder muskets and THOSE weapons and THOSE weapons only were what the great caucasian forefathers were covering in the 2nd amendment, when they gave Americans the right to bear arms in order to form a well regulated militia. 

 

 

A Well Regulated Militia

We have the United States Armed Forces, a well regulated militia if there ever was one, and with the United States Armed Forces, we have no need for a well regulated militia to have access to weapons of any type, let alone Bushmaster .233’s, AK-47’s, AR-15’s, all assault rifles……or Glock & Sig Sauer automatic handguns with clips holding 17 rounds.

 

OH….I almost forgot the National Guard, Border Patrol, I.C.E, C.I.A., F.B.I., N.S.A., Homeland Security, all local state and town & city law enforcement agencies.

 

If the Army, AirForce, Navy, Marines, Special Forces, SEAL Team 6, Green Berets and Army Rangers (I saved the best for last) can’t save America, I seriously doubt some gun crazed American, all hopped up on beer or meth, running from door to door, aiming to shoot anything that is different looking than him/herself….is the answer to safety & security for American citizens.

 

The National Rifle Association (NRA)

 

Lets be very clear about what the NRA are: They are a group of humans who lobby in Washington D.C. for the express purpose of ensuring the profits of all armaments and weapons manufactures, continue to roll in, making billions of dollars in revenues annually. 

 

The NRA has no other earthly purpose. The NRA does not concern itself with the 2nd amendment rights, other than using the 2nd amendment to get simple minded Americans to line up to support the billions of dollars in profit The NRA IS concerned about securing for every gun and ammunition maker in the free world.

 

The NRA does NOT care one bit for the United States Constitution…..except using it as a tool to further it’s own profitable agenda.

 

The NRA is guilty of lobbying lawmakers in D.C. and supplying those politicians with thousands of dollars in campaign contributions, to ensure those elected official vote against any and all gun control laws. IF an elected politician goes against The NRA, then The NRA works financially to make sure that politician loses re-election to a pro-NRA replacement.

Some Common Sense & Logic

 

You see, the plain simple facts and truth is the U.S. Constitution was written during a time in “history” when things were very different. The 2nd amendment does not give you, the average everyday American citizen, the right to bear arms UNLESS you are bearing those arms for the express reason of forming a well regulated militia, which we already have.  Not stockpiling for doomsday preparation or the fall of the economy or because a person of color moved into “your” neighborhood.

 

If you can read the 2nd amendment AND comprehend what you read, you will see you have no legal standing to continue to scream and yell for your 2nd amendment right to bear arms.

 

 

In Conclusion

 

If you want to follow the 2nd amendment and do what the forefathers wanted you to do as an American, then you can go out and purchase a flintlock pistol, and a few black powder muskets. The 2nd amendment has NO provision for you to bear arms unless you are forming a well regulated militia. The 2nd amendment does not allow you to own automatic handguns or assault weapons.

 

So sorry.

Tim Scott is America’s newest senator today after getting tapped by South Carolina Gov. Nikki Haley (R) to fill the vacancy left by former Sen. Jim DeMint (R-SC). DeMint announced this month that he was leaving the Senate to head up the Heritage Foundation, an arch-conservative think tank in Washington DC.

Though DeMint left big, controversial shoes to fill for Republicans, few conservatives will be disappointed with Scott’s record. Elected to Congress just two years ago in the Tea Party wave, Scott has already garnered headlines for his plan to impeach President Obama, his legislation to cut off union members’ children from food stamps, and his defense of Big Oil.

It’s Time: Mayors Against Illegal Guns; Demand A Plan

The chilling picture above, showing more than 60 mass murders that have taken place in the United States in the last 30 years. The problem is shown by the list of tragedies in 2012 alone: NewtownAuroraOaklandOak Creek13 in total. It is shown by the other incidents that but for fortune or divine intervention could have become massacres, such as the man who, three days before Aurora, walked into a bar in Tuscaloosa, Alabama with an assault rifle and opened fire, injuring 17. The problem, speaking plainly, is that handguns and assault weapons need to be outlawed in America.

 

 

How do we begin to recover?

 

 

Words cannot express our heartbreak as we grieve for the children and educators killed in Newtown on Friday. As an American, I cannot even begin to imagine what the victims’ families are going through. Connecticut is my home, it’s your home, it’s home to us all and this senseless tragedy is unfathomable to all states — and the nation.

 

As President Obama stated in last night’s press conference, we must take responsibility for each other and we must take responsibility to make sure this does not happen again.

 

Too many families have faced heartbreak this year.

 

Join us in a national campaign for an assault weapons ban.

 

Now is the time for life-saving, common-sense legislation that would again ban semi-automatic weapons along with the high-capacity magazines that feed them.

 

The tragic tale of these shootings sadly repeats a common theme — in Tucson, Aurora and Newtown, the killer used semi-automatic guns to unleash hundreds of bullets at his victims.

 

But gun violence is not new. Since 1982 more than 75% of mass-murders were committed with legally obtained weapons and most were semi-automatic. Of the 12 deadliest shootings in U.S. history, half have happened since 2007 — the last assault weapons ban bill expired in 2004.

 

 

I wonder how many “assault rifle enthusiasts” lost loved 1’s or family in Aurora, Columbine, Newtown or the 31,349 gun deaths in, in America alone, in 2011?

 

No community should ever again have to feel this level of grief. We must do everything we can to prevent this from happening again. Now is the time — we’ve lost too much already.

 

Together we can put sensible restrictions in place to prevent future tragedy. There’s more we can do — improve background checks, closing the gun-show loophole — but this is a critical first step to save lives. With Members of Congress set to introduce legislation that would bring back the assault weapons ban, now is the time to stand together and ban these killer weapons.

Tracey Lane’s son Jarett was murdered in the mass shooting at Virginia Tech on April 16, 2007, along with 31 of his classmates and professors. The shooter had been adjudicated mentally ill and was prohibited from buying firearms. But his mental health records had not been submitted to the background check database, so he was able to pass a check and buy the murder weapons from a licensed gun dealer. Jarrett had just turned 22.

I’m convinced if more people heard these stories — saw the face of a mourning mother or heard a father describe the dreams his child – killed with a gun – will never reach — they would join us in demanding that our lawmakers fix our broken gun laws.

 

My own daughter was shot in the 2007 Virginia Tech massacre. But Emily was one of the lucky ones — she survived.

 

Every day, 34 Americans are murdered with guns. That means more than 48,000 people will be killed in President Obama’s next term.

Here is the typical dumbass response to gun control issues in America….

 

“In 2011 there were 323,432 auto related deaths in the US. As I see t the car is a much more deadly offender. Why not outlaw cars? If my math is correct that’s more than ten times the number of gun related deaths. But I guess you don’t care about those people do you. GUNS DON’T KILL PEOPLE, PEOPLE KILL PEOPLE!!!! I have never seen a trigger pull its self. I’m sure OJ didn’t use a gun. I think we should outlaw knives now too.”

 
Now if this Americans children were massacred by a person with a Glock and a Sig Sauer handgun, AND a Bushmaster .223 assault rifle…think he would then be for gun control laws??

 

I’ll guess that answer is NO. We just can’t fix stupid.

 

In America there were 31,349 gun deaths in 2011.

 

 

President Obama at Prayer Vigil for Connecticut Shooting Victims: “Newtown, You Are Not Alone

 

Yesterday, President Obama traveled to Newtown, CT to meet with the families of those who were lost in Friday’s tragic shooting, and to thank first responders for their work.

 

In the evening, the President spoke at an interfaith vigil for families of the victims, and all families from Sandy Hook Elementary School. He offered the love and prayers of a nation grieving alongside Newtown.

President Obama also spoke about the need to engage Americans in efforts to prevent tragedies like the one in Newtown, reiterating that America’s first job is caring for our children:

 

And by that measure, can we truly say, as a nation, that we are meeting our obligations?  Can we honestly say that we’re doing enough to keep our children — all of them — safe from harm?  Can we claim, as a nation, that we’re all together there, letting them know that they are loved, and teaching them to love in return?  Can we say that we’re truly doing enough to give all the children of this country the chance they deserve to live out their lives in happiness and with purpose?

 

I’ve been reflecting on this the last few days, and if we’re honest with ourselves, the answer is no.  We’re not doing enough.  And we will have to change.

 

Since I’ve been President, this is the fourth time we have come together to comfort a grieving community torn apart by a mass shooting.  The fourth time we’ve hugged survivors.  The fourth time we’ve consoled the families of victims.  And in between, there have been an endless series of deadly shootings across the country, almost daily reports of victims, many of them children, in small towns and big cities all across America — victims whose — much of the time, their only fault was being in the wrong place at the wrong time.

 

We can’t tolerate this anymore.  These tragedies must end.  And to end them, we must change.  We will be told that the causes of such violence are complex, and that is true.  No single law — no set of laws can eliminate evil from the world, or prevent every senseless act of violence in our society.

 

But that can’t be an excuse for inaction.  Surely, we can do better than this.  If there is even one step we can take to save another child, or another parent, or another town, from the grief that has visited Tucson, and Aurora, and Oak Creek, and Newtown, and communities from Columbine to Blacksburg before that — then surely we have an obligation to try.
