IRS Profiling The Tea Party Scandal….ain’t no scandal. 

If you want a profiling scandal, try being a Person of Color, a member of the LGBTQ community, or a Female, especially in the military or a Woman wanting to exercise your right to have an abortion, try being Islamic, or a Senior Citizen. We get profiled daily, so I find it scandalous that the Tea Party, a clear political party, is bitchin over The IRS profiling their dumbasses.

A 501(c) organization, also known colloquially as either a 501(c) or a “nonprofit“, is an American tax-exempt nonprofit organization. Section 501(c) of the United States Internal Revenue Code (26 U.S.C. § 501(c)) provides that 28 types of nonprofit organizations are exempt from some federal income taxes. Sections 503 through 505 set out the requirements for attaining such exemptions. Many states refer to Section 501(c) for definitions of organizations exempt from state taxation as well.

Political activity

Section 501(c)(3) organizations are absolutely prohibited from supporting political candidates, and are subject to limits on lobbying. They risk loss of tax exempt status if these rules are violated.

Elections

Organizations described in section 501(c)(3) are prohibited from conducting political campaign activities to intervene in elections to public office. The Internal Revenue Service website elaborates upon this prohibition as follows:

Under the Internal Revenue Code, all section 501(c)(3) organizations are absolutely prohibited from directly or indirectly participating in, or intervening in, any political campaign on behalf of (or in opposition to) any candidate for elective public office. Contributions to political campaign funds or public statements of position (verbal or written) made on behalf of the organization in favor of or in opposition to any candidate for public office clearly violate the prohibition against political campaign activity. Violating this prohibition may result in denial or revocation of tax-exempt status and the imposition of certain excise taxes.Certain activities or expenditures may not be prohibited depending on the facts and circumstances. For example, certain voter education activities (including presenting public forums and publishing voter education guides) conducted in a non-partisan manner do not constitute prohibited political campaign activity. In addition, other activities intended to encourage people to participate in the electoral process, such as voter registration and get-out-the-vote drives, would not be prohibited political campaign activity if conducted in a non-partisan manner.

On the other hand, voter education or registration activities with evidence of bias that (a) would favor one candidate over another; (b) oppose a candidate in some manner; or (c) have the effect of favoring a candidate or group of candidates, will constitute prohibited participation or intervention.

The Internal Revenue Service provides resources to exempt organizations and the public to help them understand the prohibition. As part of its examination program, the IRS also monitors whether organizations are complying with the prohibition.

Lobbying

In contrast to the absolute prohibition on political campaign interventions by all section 501(c)(3) organizations, public charities (but not private foundations) may conduct a limited amount of lobbying to influence legislation. Although the law states that “No substantial part…” of a public charity‘s activities can go to lobbying, charities with large budgets may lawfully expend a million dollars (under the “expenditure” test), or more (under the “substantial part” test) per year on lobbying. To clarify the standard of the “substantial part” test, Congress enacted §501 (h) (called the Conable election after its author, Representative Barber Conable). The section establishes limits based on operating budget that a charity can use to determine if it meets the substantial test. This changes the prohibition against direct intervention in partisan contests only for lobbying. The organization is now presumed in compliance with the substantiality test if they work within the limits. The Conable Election requires a charity to file a declaration with the IRS and file a functional distribution of funds spreadsheet with their Form 990. IRS form 5768 is required to make the Conable election.

Based on this information from Wikipedia…..the Tea Party is INELIGIBLE for 501(c) status.

So are The NRA.

“Nearly two years after a controversial decision to investigate the NAACP for criticizing President Bush during the 2004 presidential campaign, the Internal Revenue Service has ruled that the remarks did not violate the group’s tax-exempt status.”

Julian Bond rightfully criticized Dubyah, and it was fine for intrusion from the insidious IRS? Where was the public outrage? The president has stated that he will hold these idiots, who “unfairly targeted” the Tea Party morons accountable. What’s acceptable for the NAACP is CLEARLY unacceptable for the GOP?

The Benghazi Scandal……Ain’t No Scandal

Rep. Jason Chaffetz (R-Utah) acknowledged on Wednesday that House Republicans had consciously voted to reduce the funds allocated to the State Department for embassy security since winning the majority in 2010.

Rep. Jason Chaffetz (R-UT) said today that he voted to cut funding for U.S. embassy security amid political attacks from Republicans that the Obama administration did not do enough to secure the U.S. diplomatic mission in Benghazi, Libya that was attacked last month.

Republicans and their allies have been trying to politicize the attack — which killed four Americans, including the U.S. Ambassador to Libya — suggesting, without evidence, the Obama administration may have ignored intelligence that the attack was imminent, didn’t properly secure the Benghazi compound and is now trying to cover it up.

But hidden beneath the GOP campaign is the fact that House Republicans voted to cut nearly $300 million from the U.S. embassy security budget. When asked if he voted to cut the funds this morning on CNN, Chaffetz said, “Absolutely“

Barbara Boxer ‘The Benghazi Scandal’ ‘Starts With Republicans’ Who Cut Funding For Embassy Security

In a speech on the Senate floor on Tuesday, Sen. Barbara Boxer (D-CA) said that Republicans in Congress should look into a mirror when asking why the attack on an American consulate in Benghazi was as deadly as it was. She said that House Republicans who voted to cut security funding for overseas embassies are directly responsible for the lack of security personnel at that outpost. Boxer’s claim is contradicted by testimony delivered before a Congressional Oversight Committee hearing last week.

Boxer exonerated former Secretary of State Hillary Clinton on Tuesday for any responsibility relating to the Benghazi attack, saying that it she testified before Congress in good faith and took full responsibility for what occurred under her watch.

“It takes funding to protect a consulate,” Boxer said. “Who cut the funds from embassy security? The Republicans in the House. That’s who.”

See….no such Benghazi Scandal exist. The GOPretenders are responsible…..for doing jack shit. As Usual.
